1. Agreement to Terms

By downloading, installing, or using Every Round ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

Acknowledgement: These Terms are a legally binding agreement between you ("End-User") and Tanmay Nargas ("Developer", "we", "our", or "us") only, and not with Apple Inc. ("Apple"). Apple is not a party to these Terms and is not responsible for the App or its content. We, not Apple, are solely responsible for the App and its content.

2. Description of Service

Every Round is an AI-powered interview coaching application designed for mock interview practice and personal skill development. The App provides simulated interview sessions, AI-generated feedback, eye contact analysis, speech coaching, and performance analytics to help you improve your interviewing ability through practice.

3. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions. You may also access the App through Family Sharing or volume purchasing as permitted by Apple.

This license does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

The following uses are not permitted under these Terms:

5.1 Live Interview Misuse

You may not use the App, or any part of its functionality, during or in connection with an actual, live, or real-time job interview with an employer, recruiter, or interviewer. This includes, for example:

  • Running the App in the background during a live interview conducted in person, over video call, or via phone
  • Using the App to receive real-time assistance, prompts, or suggested answers during an actual interview
  • Screen sharing the App or its output with third parties during an interview
  • Attempting to conceal the App from interviewers or employers during any interview process
  • Requesting features or modifications intended to make the App harder to detect during a live interview
  • Using the App to misrepresent your unaided abilities to an employer, recruiter, hiring platform, or other third party

5.2 General Misuse

You may not:

  • Reverse engineer, decompile, or tamper with the App
  • Use the App in any way that violates applicable laws or regulations
  • Attempt to circumvent account bans or suspensions
  • Use the App to facilitate fraud or misrepresentation to any third party
  • Share your account credentials or allow others to access your account

5.3 Third Party Terms

When using the App, you must comply with all applicable third-party terms of agreement. If you use the App while connected to a wireless network, you must not be in violation of your wireless data service agreement.

6. Account Suspension or Termination

We may suspend, restrict, or terminate access to the App if we reasonably believe your account is being used in violation of these Terms, to facilitate fraud or deception, or in a way that creates risk to other users, employers, recruiting platforms, or the integrity of the service.

If we suspend or terminate your access, we may also disable future use of affected accounts, devices, or related credentials where reasonably necessary to enforce these Terms and protect the service.

7. Subscriptions and Payments

Every Round offers optional premium subscriptions processed through the Apple App Store. By subscribing, you agree to Apple's payment terms. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your Apple ID account settings.

We do not process or store your payment information directly. Billing, subscription management, and refund requests are handled by Apple and may also be subject to applicable law.

8. Maintenance and Support

We are solely responsible for providing maintenance and support services for the App, as described in these Terms or as required by applicable law. Apple has no obligation to furnish any maintenance or support services with respect to the App.

9. Warranty

The App is provided "as is" and "as available." We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. We make no representations or guarantees regarding:

We make no representation that use of the App during a live interview would be permitted, appropriate, or undetectable by any employer, interview platform, or third-party monitoring software.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are our sole responsibility.

10. Product Claims

You and we acknowledge that we, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

11. Intellectual Property

All content, features, and functionality of the App, including but not limited to AI models, feedback algorithms, UI design, and branding, are our exclusive property and are protected by applicable intellectual property laws.

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

12. Limitation of Liability

To the maximum extent permitted by applicable law, we and our developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. This includes any consequences arising from misuse of the App in violation of these Terms, including consequences related to deceptive use during job interviews. Your use of the App for prohibited purposes is entirely at your own risk.

13. Legal Compliance

By using the App, you represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless us and our developers from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the App, your misuse of the App, or your violation of these Terms.

15. Third Party Beneficiary

You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

16. Governing Law

These Terms are governed by applicable law. Any dispute arising from these Terms or your use of the App will be resolved in a court of competent jurisdiction unless applicable law requires otherwise.

17. Changes to These Terms

We may update these Terms from time to time. For material changes, we may provide notice in the App, on our website, or through other reasonable means. In some cases, we may require you to review and accept the updated Terms before you can continue using the App.
